I. TERMS OF USE OF GOLDNUMIS.COM

These Terms and Conditions govern the relationship between “ARKUS ECO METAL” Ltd., hereinafter referred to as “GOLDNUMIS.COM”, on the one hand, and the Users of the internet pages and services located on the Website (hereinafter referred to as Users), on the other hand.

“ARKUS ECO METAL” Ltd. is a company registered under the Commercial Act of the Republic of Bulgaria with UIC 175221259, having its registered office and management address: Sofia, 5 Yana Str., office 4, email address: office@goldnumis.com, phone: +359887201777.

Please read these Terms and Conditions carefully before using the informational and commercial services offered on the Website (hereinafter referred to as Services). By accessing the Website, each User automatically agrees to comply with the conditions described below.

This document contains information about the activity of GOLDNUMIS.COM and the general terms for the use of the services provided by GOLDNUMIS.COM, regulating the relationship between us and each of our users.

Confirmation of the Terms and Conditions is a necessary and mandatory condition for concluding a contract between the User and GOLDNUMIS.COM.

By accepting the Terms and Conditions, the User agrees that their personal data may be processed based on the contract concluded between them and GOLDNUMIS.COM. Such data include names, phone number, address, email, and identification documents.

II. DEFINITIONS

For the purposes of these Terms and Conditions, the following terms shall be understood as follows:

• Website – http://www.GOLDNUMIS.COM and all its subpages.

• User – any natural or legal person who acquires goods or uses services.

• Terms and Conditions – the present Terms and Conditions, which include terms of use, personal data protection policy, cookies, registration and delivery rules, voluntary dispute resolution, withdrawal and replacement forms, and any other legally significant information located on the Website.

• Personal data – any information about a natural person that reveals their physical, psychological, mental, family, economic, cultural, or social identity.

• Goods – tangible movable property, except for items sold through enforcement procedures or other measures by legally authorized bodies, as well as items abandoned or confiscated for the benefit of the state, declared for sale by state authorities.

• Sales contract – a contract under which the trader transfers or undertakes to transfer ownership of goods to the consumer, and the consumer pays or undertakes to pay their price, including contracts involving both goods and services.

• Alternative Dispute Resolution procedure – a procedure for out-of-court settlement of consumer disputes, in compliance with a special law or specific agreement between the parties to a given relationship, carried out by a body for alternative dispute resolution (arbitration, mediation, or others).

III. SERVICES PROVIDED

1. The Website is an e-commerce platform accessible at www.goldnumis.com, through which Users may enter into contracts for the purchase and sale and delivery of the goods offered by GOLDNUMIS.COM, including:

   • registering and creating a user profile to view GOLDNUMIS.COM and use the additional information services;

   • reviewing goods, their characteristics, prices, and delivery terms;

   • concluding contracts for the purchase and sale of goods offered by GOLDNUMIS.COM;

   • making payments in relation to the contracts concluded with GOLDNUMIS.COM, according to the payment methods supported on the Website;

   • receiving information about new goods offered by GOLDNUMIS.COM;

   • making electronic statements in connection with the conclusion or performance of contracts with GOLDNUMIS.COM via the Website’s interface.

2. GOLDNUMIS.COM delivers the goods and guarantees the User’s rights as provided by law and under the terms and conditions set forth on the Website, in good faith, according to professional standards, and consumer rights legislation.

3. Users enter into a contract for the purchase and sale of goods through the Website at www.goldnumis.com, available in Bulgarian and English.

4. By virtue of the contract concluded with the Users for the purchase and sale of goods, GOLDNUMIS.COM undertakes to deliver and transfer ownership of the goods specified by the User through the Website interface, and the User undertakes to pay the agreed price and accept the goods.

5. Users pay GOLDNUMIS.COM a price for the goods delivered, as announced on the Website at the time of order submission. The price may be paid under the conditions provided on the Website.

6. GOLDNUMIS.COM delivers the goods requested by the Users within the terms and under the conditions specified on the Website. The delivery terms are announced on the Website.

7. The cost of delivery, if not included in the price of the goods, is determined separately and explicitly stated before the order is finalized and by the conclusion of the contract.

IV. REGISTRATION AND IDENTIFICATION

“GOLDNUMIS.COM” identifies the Users of the website through the storage of log files on the Site’s server and the User’s IP address.
“GOLDNUMIS.COM” has the right to collect and use information regarding the Users on the basis of and for the purposes of the performance of the contract concluded with the User under these General Terms and Conditions. The information by which a person may be identified may include names, telephone number, address, email, as well as any other information that the person voluntarily provides during registration. The information also includes any other data that the User enters, uses, or provides when using the Services provided by “GOLDNUMIS.COM”.

Only persons over 18 years of age may register on the website. Upon registration, the individual ticks a checkbox with which they declare that they are over 18 years of age.

“GOLDNUMIS.COM” exercises due care and is responsible for protecting the information about the User that has become known in connection with the registration, except in cases of force majeure, accidental events, or malicious actions by third parties.

In the registration form completed by the User during registration, “GOLDNUMIS.COM” designates the mandatory or voluntary nature of providing the data and the consequences of refusal to provide them.

“GOLDNUMIS.COM” may disclose personal data to third parties only in cases provided for by law and under the circumstances provided for by law, or with the express consent of the Users.

The User may register by completing the relevant electronic registration form available in real time (online) on the website of “GOLDNUMIS.COM” and by expressing consent to the General Terms and Conditions.

By pressing the virtual button with the text “Registration” or another analogous text, which has the force of written confirmation of the General Terms and Conditions, the User makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, by which he/she declares that he/she is acquainted with the General Terms and Conditions, accepts them, and undertakes to comply with them.

“GOLDNUMIS.COM” may store in log files on its server the User’s IP address, as well as any other information necessary to identify him/her and to reproduce his/her electronic statement of acceptance of the General Terms and Conditions in the event of a legal dispute. The text of the General Terms and Conditions is accessible on the Internet on the website of “GOLDNUMIS.COM” in a manner that allows its storage and reproduction.

When completing the registration application, the User is obliged to provide full and accurate data regarding identity (for natural persons), legal status (for legal entities), and other data required by the electronic form of “GOLDNUMIS.COM”, as well as to update them within 7 (seven) days of their change. The User declares that he/she agrees to provide the personal data thus required, thereby guaranteeing that the data provided during the registration process are true, complete, and accurate, and that in case of changes he/she will update them in due time. In case of providing false data, “GOLDNUMIS.COM” has the right to terminate or suspend immediately and without notice the provision of the services, as well as the maintenance of the User’s registration.

Upon registration, the User receives a unique username, which may also be the email specified by the User, and a password for access to the services available through the website of “GOLDNUMIS.COM”.

The User may manage his/her user profile on the website. Through the profile, the User may:

1. View the history of orders placed

2. Track the status of the order

3. Modify and add to the addresses registered by him/her

4. View and modify the list of “Favorite” products

The username with which the User registers does not grant him/her any other rights, except those expressly specified in these General Terms and Conditions.

A registrant, acting as a representative of a legal entity, is obliged to enter his/her full name and address, respectively the name of the legal entity he/she represents.

The User is obliged to exercise all due care and to take the necessary measures that are reasonably required in order to protect his/her password, as well as not to disclose his/her password to third parties, and to notify “GOLDNUMIS.COM” immediately in case of unauthorized access, as well as of the likelihood or suspicion of such. He/she bears the responsibility and risk for the protection of his/her password, as well as for all actions carried out by him/her or by a third party through the use of his/her password.

V. ORDER

Users use the interface of the “GOLDNUMIS.COM” website to conclude contracts for the purchase and sale of goods and services offered by “GOLDNUMIS.COM.”
In the absence of availability of a given product, “GOLDNUMIS.COM” reserves the right to refuse the order.
After selecting one or more goods offered on the “GOLDNUMIS.COM” website, the User must add them to their shopping list.
It is necessary for the User to provide data for the delivery to be carried out and to choose the method and time of payment of the price, after which to confirm the order through the website interface.
Upon placing an order, the User receives confirmation by email that their order has been accepted.
“GOLDNUMIS.COM” has the right to refuse to conclude a contract with an incorrect User.
“GOLDNUMIS.COM” has the right to treat a User as incorrect in cases where:

1. there is non-compliance by the User with the General Terms and Conditions;

2. incorrect, arrogant or rude behavior towards representatives of “GOLDNUMIS.COM” has been established;

3. abuses by the User towards “GOLDNUMIS.COM” have been established.

VI. HOW TO PLACE AN ORDER

Orders are accepted on the website 24 hours a day, 7 days a week, including weekends and official holidays. In order for an order to be generated through the website, registration of a user profile is mandatory. Ordering of specific goods selected by the User is carried out as follows:
order through the website – you can place an order through the website by using the “Add to cart” button, which is located next to each available product. This button adds the selected product to the user’s cart, after which the user has the option to add more products to it or to proceed to completing the order. Upon completion of the order, the user has the opportunity to review the products they have decided to purchase, their prices, and the final amount payable. The user can complete the order with an already registered user profile or register a new one. After finalizing the order and submitting the request thus made, confirmation with a record of the entered information will be sent to the specified email. For each stage of the processing of the order (confirmation, receipt of payment, dispatch, and others), the user will be notified by www.GOLDNUMIS.COM via email or phone, while the status of the current as well as previous orders can also be tracked by the user from their user profile on www.GOLDNUMIS.COM.
Orders and inquiries from customers are processed by www.GOLDNUMIS.COM within working hours. By exception, they may also be processed outside working hours and/or on weekends and holidays.
All images and descriptions of products on the website www.GOLDNUMIS.COM are valid for the specific product to which they relate. Exceptions are possible only for certain products in the INVESTMENT GOLD COINS section, when this is explicitly stated.
All prices, including promotional prices, are valid until the moment they are changed by www.GOLDNUMIS.COM or the product is withdrawn from sale or sold out. Any such change is reflected on the website www.GOLDNUMIS.COM.

VII. ORDER PRICE

(1) The prices of the goods offered are those indicated on the website of “GOLDNUMIS.COM” at the time of placing the order.
The prices of the goods indicated on the website of “GOLDNUMIS.COM” are linked to and directly depend on the price of gold on the international financial markets and change every 10 minutes.
The prices of the goods include VAT, in cases where its charging is provided.
“GOLDNUMIS.COM” reserves the right to change at any time and without notice the prices of goods offered on the website, such changes not affecting orders already placed. The change of the price is valid for Users from the moment of its announcement on the website www.GOLDNUMIS.COM.

(2) “GOLDNUMIS.COM” may provide discounts for the goods offered on the website, in accordance with Bulgarian legislation and rules set by “GOLDNUMIS.COM.” The rules applicable to such discounts are available at the place where the discount is shown.
(3) The final price of the order is formed by the price of the goods, to which the value of the delivery and insurance is added, and possibly a “Cash on delivery” fee, if the User has chosen the method of payment – “Cash on delivery.”

IX. PAYMENT METHODS

(1) The user can pay the price of the ordered goods using one of the options listed on the Site at their discretion. Payment on the Site can be made in one of the following ways: through the payment initiation platform (PIS) Open banking of our partner Paysera, bank transfer, cash (upon personal collection of the order), with cash on delivery, or with a debit/credit card.

1. Bank transfer payment, initiated from your bank account to the bank accounts of ARKUS ECO METAL Ltd. This is possible after you have selected "bank transfer" as the payment method. We accept payments in BGN or EUR. After January 1, 2026, we will only accept payments in EUR. The payment must be made from the bank account of the person receiving the order. For your security and convenience, after making the payment, you can send a copy of the payment order to the email address of WWW.GOLDNUMIS.COM – sales@goldnumis.com.

2. Payment via the Open Banking payment initiation service (PIS) of Paysera: The user completes the order, selects the "Open Banking" payment method, and chooses their bank from the supported options. Then they enter their bank access details and confirm the payment. Funds are transferred from the customer's bank account to the account of ARKUS ECO METAL Ltd. in Paysera.

3. Cash payment – possible only for orders up to 5000 EUR. You can pay the value of the order this way if you have chosen "personal collection" as the delivery method and "cash payment" as the payment method. Upon receiving the ordered goods at the company's office, you pay the price of the goods.

4. Cash on delivery: upon receipt of the goods, you pay the due amount to the courier. With this payment method, the cost of the "Cash on Delivery" service is paid by the recipient of the shipment. There are two options available here:

   • Pay the cash on delivery amount to the courier in cash.

   • Pay the cash on delivery amount with your credit/debit card directly to the courier.
     If the user chooses the option for delivery by courier and payment with cash on delivery, they must pay the price of the ordered items along with the cost of the "Cash on Delivery" service to the courier upon receiving the goods.

X. WITHDRAWAL FROM THE CONTRACT
All products offered on the website "GOLDNUMIS.COM" are directly related and dependent on the price of gold on international financial markets. According to Article 57(2) of the Consumer Protection Act - The provisions of Articles 50-56 regarding the consumer's right to withdraw from the contract at a distance or from the contract outside the commercial establishment do not apply to contracts:
"for the supply of goods or services whose price depends on fluctuations in the financial market that cannot be controlled by the trader and which may occur during the period for exercising the right of withdrawal;"

XI. INTELLECTUAL PROPERTY
(1) The intellectual property rights over all materials and resources located on the website of "GOLDNUMIS.COM" (including available databases) are protected under the Copyright Act and belong to "GOLDNUMIS.COM" or the respective person who has granted the right of use to "GOLDNUMIS.COM" and cannot be used in violation of applicable legislation. In case of copying or reproduction of information beyond what is allowed, as well as any other infringement of the intellectual property rights over the resources of "GOLDNUMIS.COM", "GOLDNUMIS.COM" has the right to claim compensation for direct and indirect damages in full amount.
Except where expressly agreed otherwise, the User may not reproduce, modify, delete, publish, distribute, or disclose in any other way the information resources published on the website of "GOLDNUMIS.COM".
(2) "GOLDNUMIS.COM" undertakes to take due care to ensure that the User has normal access to the provided services. "GOLDNUMIS.COM" reserves the right to discontinue access to the provided services. "GOLDNUMIS.COM" has the right, but not the obligation, at its discretion to delete information resources and materials published on its site.

XII. TERMINATION AND CANCELLATION OF THE AGREEMENT. COMPLAINT ABOUT PURCHASED GOODS.
"GOLDNUMIS.COM" has the right, at its sole discretion and without prior notice, to unilaterally terminate the agreement if it determines that the provided services are being used in violation of these Terms and Conditions, Bulgarian legislation, and/or generally accepted moral norms.
In addition to the cases provided for in these General Terms and Conditions, the agreement between the parties is terminated upon cessation of the activities of "GOLDNUMIS.COM" or discontinuation of maintaining its website.
Outside of the above-mentioned cases, either party may cancel this agreement by giving one week's notice to the other party in case of non-fulfillment of obligations under the agreement.
The written form of the agreement is considered fulfilled by sending an email message, clicking an electronic button on a page with content that is filled out or selected by the User, checking a box on the website, etc., as long as the statement is recorded technically in a manner that allows it to be reproduced.
Complaint and return of purchased products is possible only upon proven doubt about the authenticity of the purchased product. "GOLDNUMIS.COM" guarantees the authenticity of all products offered on the site and maintains an archive of high-resolution photos of all coins sold through the site.

XIII. DELIVERY WITHIN THE EU

When completing the order, customers can choose the following delivery methods:

• Delivery via ECONT – only to an office of the courier company ECONT. This option is valid only for deliveries within Bulgaria. All orders for Bulgaria to an ECONT office with a value above 400 EUR are delivered with FREE SHIPPING AND INSURANCE. For orders under 400 EUR, a shipping fee of 2 EUR applies, which includes free insurance. If the payment method “Cash on Delivery” is chosen, the service fee for “Cash on Delivery” is paid by the Customer.

• Delivery via DHL – the delivery is made to the address provided by the Customer in an EU country. The cost of delivery including insurance is 50 EUR. The parcel is handed personally to the Customer or to an authorized representative.

• Personal delivery – in the office of GOLDNUMIS.COM. Customers can order online from GOLDNUMIS.COM and select the delivery option "Personal delivery," thereby benefiting from FREE SHIPPING, regardless of the purchase value.

Before shipping the ordered goods, GOLDNUMIS.COM has the right to contact the Customer at the phone number provided in order to clarify details regarding the order and/or delivery.
The dispatch time is between 1 and 3 working days after order confirmation and receipt of payment. In exceptional circumstances, “ARKUS ECO METAL” reserves the right to extend the delivery period, while promptly informing the Customer.

“ARKUS ECO METAL” Ltd. is not responsible for failure to fulfill an order in cases where the Customer has provided false, incomplete, and/or inaccurate personal information, including an incomplete, inaccurate, or fictitious address or phone number.

XIV. DELIVERY OUTSIDE THE EU

Delivery outside the EU is possible. If you would like products to be shipped outside the EU, please contact us in advance at sales@goldnumis.com.

XV. INVALIDITY CLAUSE

The Parties declare that, in the event that any of the clauses of these General Terms and Conditions prove to be invalid, this shall not entail the invalidity of the entire agreement or other parts thereof. The invalid clause will be replaced by the mandatory provisions of the law or established practice.

XVII. DISPUTES

Customers may use the European Online Dispute Resolution (ODR) platform, available at http://ec.europa.eu/odr – a single access portal that allows consumers and traders in the EU to resolve disputes.

Alternative dispute resolution (ADR) between consumers and traders represents an out-of-court conciliation procedure on a voluntary basis. General conciliation commissions assist in reaching an agreement between consumers and traders in disputes concerning contracts for the sale of goods and provision of services. The general conciliation commissions are determined on a regional basis, and the competent body to resolve disputes between “GOLDNUMIS.COM” and the Customer is the General Conciliation Commission at the Consumer Protection Commission, seated in Sofia and covering Sofia City, Sofia District, Kyustendil District, and Pernik District.

Disputes that cannot be resolved otherwise shall be referred to the competent Bulgarian court.
